The Opening Brief in the lawsuit to stop the commercial downhill bike park at Timberline Lodge has been filed. It is hoped that the oral presentations in Federal Court will happen at the end of May.
The Opening Brief can be read in the below link. The document presents the argument against the action taken by the U.S. Forest Service. The basic premise of the brief is that the USFS was in error when it declined to order an Environment Impact Statement analysis for the proposal.
The brief provides an excellent summary of all that has occurred since we first learned that the USFS was planning to allow RLK and Company to construct this bike park without the proper environmental analysis.
We are very pleased with the work of the team at Crag Law Center. It is due to their excellent effort that we are very optimistic about the outcome.
